GENERAL GIVEAWAY TERMS AND CONDITIONS OF CLICKATELL (PTY) LTD

1. INTRODUCTION

1.1   Clickatell will be hosting a giveaway during the 8th – 10th November 2022 held at Africa Tech 2022 (the “Giveaway”).

2. ELIGIBILITY

2.1   To participate in this Giveaway you must be a natural person over the age of 18 years.

2.2   The following person/s are expressly excluded from participating in the Giveaway:

2.2.1         a director, employee, agent of, or consultant to Clickatell or any other person who directly or indirectly controls or is controlled by Clickatell;

2.2.2         a director, employee, agent of, or consultant to a supplier of goods or services in connection with the Giveaway; and/or

2.2.3         the spouses, life partners, business partners or immediate family members of the parties referred to in clauses 2.1 and 2.2 above.

3. HOW TO ENTER

3.1   Visit the Clickatell booth or engage with a Clickatell representative during the Giveaway period and have your details captured by a Clickatell representative to be entered into a random draw and stand a chance to win the Bundle as stipulated below.

4. THE PRIZE

4.1   The winners of the Giveaway will each receive an Apple iPad 9 and accessories (the “Bundle”).

4.2   A Participant will be eligible to win only one Bundle per Giveaway. Only one winner will be chosen per day of the Giveaway. All decisions in relation to the Giveaway (including but not limited to the award of the Bundle or the disqualification of any Participants) are that of Clickatell alone and solely within Clickatell’s discretion.

4.3   The Winners will be randomly drawn from a pool of all Participants by Clickatell and will be notified via the Africa Tech Connect App that they have won the Bundle. The winner will be given a period of 2 hours from notification to contact Clickatell and arrange to collect the Bundle at the Clickatell booth. Should the winner fail to collect the Bundle within this period, the winner will forfeit the Bundle and a new winner will be chosen at random.

4.4   the Bundle is non-transferable, non-refundable, and cannot be exchanged or redeemed for cash.

5. LIMITATION OF LIABILITY

5.1   Insofar as is permitted by law, Clickatell, its employees or agents, will not in any circumstances be responsible or liable to compensate the winner, nor will Clickatell, its employees or agents accept any liable to loss, damage, personal injury or death occurring as a result of taking up the Bundle.

5.2   Clickatell does not guarantee the fitness and/or suitability of the Bundle for a specific use and will not be held liable for any defects or damage to the Bundle, nor will Clickatell be responsible for effecting any repairs or placements of the Bundle. The winner must direct all queries relating to the Bundle to the manufacturer thereof. The contents of the Bundle are provided as is and are received from a third party supplier and Clickatell will not enter into any further correspondence in respect of the Bundle.

6. GENERAL

6.1   By entering into the Giveaway, you consent to Clickatell processing your personal information (including but not limited to your likeness and your company details) for promotional purposes in order to conduct this Giveaway.

6.2   Proof of identity will be required to collect a Bundle and Clickatell reserves the right to refuse handing over of a Bundle to any potential winner who refuses to or cannot verify their identity.

6.3   Clickatell reserves its right to terminate the Giveaway for any reason and the right to amend these terms and conditions on reasonable notice to the Participants and will communicate such termination or amendments on Clickatell’s website and/or social media pages.
